Nineteen years experience in labor agreement negotiations to include experience with airline, non-airline, and public sector employees under the Railway Labor Act, National Labor Relations Act, Service Contract Act, Public Employees Relations Act and State law. Union lead negotiator in 95 plus collective bargaining agreements. Primary responsibility for enforcing collective bargaining agreements, including assisting in arbitration preparation. Chaired system wide System Board of Adjustment Committee (Air Canada & Continental Airlines). Chaired system wide Contract Negotiations Committee (Air Canada & Continental Airlines). Chair Labor Management Committee (Air Canada Airlines). Lead Union Representative is dozens of airline and non-airline mediations. Represented pilots, professional flight engineers, aircraft mechanics, customer service representatives, aircraft radio repair technicians, ramp employees, flight attendants, material specialists(RLA); custodians, maintenance workers, cashiers, paramedics, EMTs, nurses, sales drivers, concrete plant workers, electricians(NLRA); battalion chiefs, maintenance workers, police dispatchers,(PERC); hazardous materials technicians, drafters, maintenance workers, custodians, logistics employees, badging clerks(SCA). Experienced with Fair Labor Standards Act(FLSA); Age Discrimination in Employment Act(ADEA); Americans with Disabilities Act(ADA); Family Medical Leave Act(FMLA) and Employee Benefits (medical, pension, 401k, 401a, etc).

Mediation, as used in law, is a form of alternative dispute resolution (ADR), a way of resolving disputes between two or more parties with concrete effects. Typically, a third party, the mediator, assists the parties to negotiate a settlement. Disputants may mediate disputes in a variety of domains, such as commercial, legal, diplomatic, workplace, community and family matters.

 

The term "mediation" broadly refers to any instance in which a third party helps others reach agreement. More specifically, mediation has a structure, timetable and dynamics that "ordinary" negotiation lacks. The process is private and confidential, possibly enforced by law. Participation is typically voluntary. The mediator acts as a neutral third party and facilitates rather than directs the process.

 

Mediators use various techniques to open, or improve, dialogue and empathy between disputants, aiming to help the parties reach an agreement. Much depends on the mediator's skill and training. As the practice gained popularity, training programs, certifications and licensing followed, producing trained, professional mediators committed to the discipline.
